Pat, Michael, Jennifer and I have traveled the country to promote online notarization and online mortgage closings. Collectively, we’ve been to nearly forty states in the past eighteen months, testifying in state legislatures, presenting to county clerks and bar associations, assisting or leading the drafting efforts for new laws and regulations, and consulting with countless trade or regulatory associations. These efforts have been extremely collaborative, partnering with other state organizations across the housing finance market, land title and other industries to ensure all voices are heard. Our efforts with key industry stakeholders have also culminated in new laws passed in Texas, Nevada and Ohio as well as the launch of our mortgage product, the first ever to execute fully online mortgage closings with all necessary approvals from title underwriters, the GSEs, etc.

Notarize for Mortgage Updated: Instant MERS Registration

As I outlined in my blog post about the complications of eMortgage, an electronically executed promissory note must be delivered into the secondary market in a specific and timely manner. Given the concerns about the ownership and control of the note, the eMortgage ecosystem has developed standardized requirements that the promissory note be executed by the borrower in the form of a MISMO SMART Doc eNote. eNotes must also be stored, transferred, and registered via an eVault with connections to MERS for delivery into the secondary market. MERS is the legal system of record for identifying the Controller (holder) and Location (custodian) for the authoritative copy of a registered eNote and is the industry standard for this practice. These rules are enforced by Fannie Mae and Freddie Mac, who will not purchase electronically executed notes if they do not comply with this process.

Ohio Passes Online Notarization

Update: After passing non-uniform provisions in 2017, Ohio Governor John Kasich signed Ohio Senate Bill 263 into law on December 19, 2018, following unanimous support from the Ohio State Senate. The law makes Ohio the 10th state to recognize remote online notarization, empowering anyone to notarize documents online from anywhere at any time.

The bill will go into effect September 19, 2019.

Notarization = Headache + Hassle. At least, that’s been the notarization reputation to date, thanks to tracking down a local notary, scheduling times and sorting through paperwork, often to find out the notary is no longer available or the document was completed incorrectly.
